In the following Privacy Statement, we explain how your data is processed on the Putzmeister Website. In the event that you are forwarded to websites or apps via links from our Putzmeister Website, please inform yourself there about the respective processing of your data. This Privacy Statement also applies to these Putzmeister Companies, insofar as they are data Controllers for services in accordance with this Privacy Statement.

Where the terms “we”, “us” and “our” are used hereinafter, this refers to all Putzmeister Companies that are data Controllers within the scope of the Services and the Website, including Putzmeister.

2. Principles of data processing and storage period

2.1. Legal basis for the processing of personal data

Insofar as we obtain your consent for the processing of personal data, point (a) of Article 6 (1) GDPR is the legal basis for the processing of personal data. Any consent can be withdrawn by you with effect for the future.

When processing personal data that is required for the performance of a contract with you or your Company, point (b) of Article 6 (1) GDPR is the corresponding legal basis. This also applies to processing operations that already become relevant pre-contractually.

Insofar as processing of your personal data is necessary for the fulfillment of one of our legal obligations, point (c) of Article 6 (1) GDPR serves as the legal basis.

If the processing is necessary to protect a legitimate interest of our company or a third party and your interests, fundamental rights and freedoms do not override our legitimate interest, point (f) of Article 6 (1) GDPR serves as the legal basis for the processing.

2.2. Data storage and erasure

In principal personal data is only stored by us as long as the specific purpose as required by the purpose for which personal data is stored. If the purpose of storage ceases to apply, your data will be erased or the processing of data will be restricted.

In addition, it may be that European regulations, applicable national laws or other regulations require a longer storage of the data processed by us. If these storage periods expire, we will erase your data or restrict the processing thereof.

2.3. Recipients of data

We will generally only disclose your personal data to service providers, business partners and other third parties in accordance with the applicable data protection laws and inform you of the disclosure in accordance with legal requirements.

We may disclose personal data to service providers and require them to perform services on our behalf (processing according to Article 28 GDPR). In this context, we comply with the strict applicable national and European data protection regulations. The service providers are subject to our instructions and are subject to strict contractual restrictions regarding the processing of personal data. Accordingly, processing is only permitted to the extent necessary to perform the services on our behalf or to comply with legal requirements. 2.3.2. Web hosting

Our Putzmeister Website and thus also your data are hosted at the hosting service of Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen (hereinafter “Hetzner”) with servers in Germany and Finland.

Hetzner is certified according to DIN ISO/IEC 27001. This certificate demonstrates adequate security management, the security of data, the confidentiality of information and the availability of IT systems.

We have concluded a Data Processing Agreement with Hetzner. Hetzner also implements strict technical measures to protect your personal data. Hetzner does not disclose your personal data to third parties unless the disclosure is necessary to perform the agreed services or Hetzner has to do so to comply with the law or a valid and binding instruction from a government or regulatory authority. The data transferred for this purpose will be limited to the minimum.

2.3.3. Forwarding of your data to affiliated companies of Putzmeister

Your data will be passed on partly to other Putzmeister Companies for the purpose of processing your enquiry and providing the services provided via the Putzmeister Website.

The legal basis for this data processing is point (b) and point (f) of Article 6 (1) GDPR or the data processing agreement with the processor. To the extent that there is no contractual performance for you and no data processing agreement concluded, we have a legitimate interest in transferring the data for internal administrative purposes to the relevant Putzmeister Company and the business units responsible there. This enables the Putzmeister Group to offer you the services provided via the Putzmeister Website as efficiently as possible.

3. Your rights

Insofar as we process personal data from you, you are a “data subject” within the meaning of the GDPR. As a data subject, you have the following rights against us:

3.1. Right of access regarding the processing

You can request information from us at any time within the scope of the statutory provisions whether personal data is being processed by us. If this is the case, you have the right to request information about the scope of data processing (cf. Article 15 GDPR). Please note that the right to access regarding the processing of data may be restricted in certain legal circumstances.

3.2. Right to rectification

You have a right to obtain your data rectified and/or completed by us if the personal data processed concerning you is inaccurate or incomplete (cf. Article 16 GDPR).

3.3. Right to restriction of processing

When the prerequisites are met, you have the right to request the restriction of the processing of your personal data (cf. Article 18 GDPR).

3.4. Right to erasure

When the prerequisites are met, you can request the erasure of the personal data concerning you without undue delay. The right to erasure does not exist, for example, insofar as the processing is necessary (cf. Article 17 GDPR).

3.5. Right to information

If you have asserted the right to rectification, erasure or restriction of processing, we are obliged to inform all recipients to whom the personal data concerning you have been disclosed of this rectification or erasure of the data or restriction of processing, unless this turns out to be impossible or requires a disproportionate effort. The Controller informs about these recipients upon your request (cf. Article 19 GDPR).

3.6. Right to data portability

You have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format. In addition, you have the right to transfer this data to another company without hindrance from us, provided that the prerequisites are met (cf. Article 20 GDPR).

3.7. Right of objection

You have the right to object at any time, based on reasons arising from your particular situation, to the processing of personal data relating to you which is carried out on the basis of point (f) of Article 6 (1) GDPR (Article 21 (1) GDPR). The consequence of the objection is that Putzmeister or the respective Putzmeister Company responsible for data processing no longer processes the personal data relating to you, unless Putzmeister or the respective Putzmeister Company responsible for data processing can demonstrate compelling legitimate reasons for the processing which override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

We ask you to direct your objection to the Putzmeister Company responsible for the data processing. We will inform you separately in the appropriate section in this Privacy Statement when the data is processed by Putzmeister Holding GmbH but by another Putzmeister Company. 3.8. Right to withdraw given consent under data protection law

If you have given your consent, you can withdraw your consent at any time. The withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the withdrawal.

3.9. Right to lodge a complaint with a data protection supervisory authority

Without affecting any other administrative or judicial appeals, you have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU Member State of your residence, place of work or place of the alleged infringement, if you consider that the processing of personal data relating to you infringes applicable data protection laws.

4. Security standards

We have implemented appropriate physical, technical and administrative security standards to protect personal data from loss, misuse, alteration or destruction. All service providers and affiliates are contractually obligated to maintain the confidentiality of personal data. In addition, they may not use the data for any purpose that have not been authorized to us.

Because the security of your data is important, your entire visit is handled over a secure TLS connection. If personal data is collected, the data transfer is also TLS-encrypted. The TLS encryption process protects your data from unauthorized access on its way through the internet.

5. Amendmends of the Privacy Statement

We may update this Privacy Statement from time to time to ensure that it remains compliant with current legal requirements or to reflect changes to our services available through the Putzmeister Website (e.g., introduction of new services). You can determine by the first paragraph of this Privacy Statement, whether anything has changed since your last visit.

B. DATA PROCESSING ON THE PUTZMEISTER WEBSITE

1. Protocol data / log files

Each time you access the Putzmeister Website, our system automatically collects data and information from your end device. In particular, the following data is collected:

  • the IP address of the requesting end device
  • the date and time of access
  • the website from which the requested file was accessed (referrer URL)
  • a description of the browser and the version of the browser used
  • if applicable, the installed operating system and the resolution set
  • the name of the file and the URL of the requested file
  • a description of the access provider you use
  • the duration of your visit
  • the amount of data transferred
  • the access status (i.e. whether the file was transferred or possibly not found, etc.)

The aforementioned data are stored in the log files of our system. In general, this data is not stored together with other personal data. To the extent access statistics are created, your IP address is anonymized by the hoster by truncating the last bytes of the IP address. Your IP address can therefore no longer be attributed to you in the access statistics.

The legal basis for the temporary storage of the data and log files is point (f) of Article 6 (1) GDPR. We have a legitimate interest in collecting and temporarily storing the aforementioned data, because the temporary storage of the IP address by the system is necessary to deliver the website to your end device. The temporary storage of the data also takes place in order to enable the delivery of the website. In addition, this data is used to optimize our website and to ensure the functionality of the website and the security of our information technology systems. The log files are not evaluated for marketing purposes.

The data stored in log files is usually erased after 30 days. The data is stored to ensure system security, e.g. to be able to clarify incidents of misuse, security or malfunctions. Data from log files whose further storage is necessary for evidence are generally excluded from erasure until the final clarification of the respective incident. This data may be passed on to investigating authorities in individual cases if necessary.

2.1. General information about cookies, pixels and similar technologies

When you use our Putzmeister Website, various types of cookies are used and stored on your end device. Cookies are small text files that are stored on your end devices when you visit our Putzmeister Website. Various information is provided to us by cookies.

Content from third parties
In order to expand and optimize the functionality of our services and to make the use more comfortable for you, we integrate content from third parties, such as maps and videos. On the website we offer you the possibility to search for the Dealer of our products, which is located closest to your immediate location. To show you suitable Dealers, we use the service Google Maps API.

The data transfer to Google takes place regardless of whether Google provides a user account via which you are logged in or whether no user account exists. If you are logged in to Google, your data will be directly assigned to your account. If you do not want the assignment with your Google profile, you must log out before activating the button.

Google stores your data as usage profiles and uses them for purposes of advertising, market research and/or demand-oriented design of its website. Such an evaluation is carried out in particular (even for users who are not logged in) for the provision of customer-oriented advertising and to inform other users of the Google network about your activities on our website. You have the right to object to the creation of these user profiles, whereby you must contact Google directly to exercise this right.

Putzmeister offers you the opportunity to contact Putzmeister via a contact form on the website. If you contact us via the contact form, the data entered in the fields will be transferred to us and stored. This includes in particular your name as well as your e-mail address and all other data entered in the fields.

In some cases, it is necessary to forward your data to other Putzmeister Companies or other third parties in order to be able to process your request in the best possible way by the relevant contact person and the relevant department.

The data is erased as soon as it is no longer required to achieve the purpose for which it was collected and the erasure also does not conflict with any mandatory archiving obligations.
